Terms of service

These terms apply when you buy from Evercarry. They do not affect your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.

Who we are

Evercarry is a UK business selling personalised photo charms, made to order.

Trading name: Evercarry
Address: 54 Mackenzie Road, Birmingham, B11 4EL, United Kingdom
Email: adamattif123@gmail.com

Placing an order

When you place an order you are making an offer to buy. We accept it when we email you a confirmation. If we cannot accept your order, we will tell you and refund you in full.

Prices are in pounds sterling and include UK delivery. We may change prices at any time, but the price you pay is the one shown when you ordered.

Your photograph

By uploading a photograph you confirm you have the right to use it. Please do not send images you do not own or have permission to use.

We use your photograph solely to make your order. It is never used for marketing or shown publicly unless you give us written permission, and it is deleted 30 days after delivery. Full detail is in our Privacy Policy.

A person checks every photograph before printing. If yours will not produce a good result, we will email you before making anything, and you may send a replacement or cancel for a full refund.

We may decline to print an image that is unlawful, obscene, or infringes someone else's rights. If we decline, we refund you in full.

What you receive

A silver-plated photo charm, 28mm, nickel-free, with a clear protective lacquer over the print. A chain is not included. The charm fits any chain up to 2.7mm thick.

Because each item is printed individually, slight variation in colour and positioning is normal. Screens differ, so the finished piece may not match your display exactly.

Delivery

Items are made to order in about five working days, then delivered free within the UK in two to three working days. Most orders arrive within seven to ten working days. These are estimates, not guarantees. We currently sell to United Kingdom addresses only.

Cancellation and returns

Because every charm is personalised with your own photograph, the 14-day right to cancel does not apply, under regulation 28(1)(b) of the Consumer Contracts Regulations 2013. We tell you this on every product page before you buy.

If your order arrives faulty, damaged or not as described, you are entitled to a repair, replacement or refund, and we pay the return postage. Beyond that, if the photograph has not come out the way you hoped, we will remake it once free of charge. Full detail is in our Refund Policy.

If something goes wrong

Email us and tell us plainly what happened. We reply within one working day. If we cannot resolve it between us, you can get free advice from the Citizens Advice consumer service.

We are responsible for loss you suffer as a foreseeable result of us breaking these terms or failing to use reasonable care. We do not limit our liability where the law does not allow us to, including for death or personal injury caused by our negligence, or for fraud.

Changes

We may update these terms. The version that applies to your order is the one published when you placed it.

Governing law

These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.
